APPLICATION, MEMBERSHIP AND SUBSCRIPTIONS
1. Acceptance of the member’s application by the Owner constitutes a contract relating to membership of the Club between the Owner and the applicant for membership subject to these terms and conditions. Membership of the Club is conditional upon the observance of these terms and conditions and all other rules and regulations made by the Owner which are applicable to membership of the Club, collectively the “Rules”. In these terms and conditions, the “Club” shall mean the Renaissance Leisure Club referred to on the front page of these terms and conditions, and the “Owner” means Hotel Property Investors UK Limited, if different, the Company which is the Owner of the Club from time to time.
2. Absolute discretion is granted to the Owner to reject any application for membership without ascribing any reason for so doing.
3. The Owner reserves the right to introduce or amend membership categories at any time. Full details of each membership are set out in available literature.
4. On acceptance of an application, all applicants will be provided with a membership card, which will remain the property of the Owner, and upon termination of membership will be returnable to the Owner on demand. Members must carry their cards when visiting the Club and show them to the Club reception or members of the Club management when asked to do so. Membership cards are in no circumstances transferable and their loss should be reported immediately to the Club reception.
5. All members shall pay a joining fee at the time of application for membership at the then current rate.
6. Members shall also pay a membership subscription which shall be fixed by the Owner. The subscription shall be payable either monthly in advance by direct debit or, if a member elects to do so, by one payment in advance for the entire membership year. The first subscription payment shall become due and payable on the date on which the applicant’s application is accepted.
7. The Owner has the absolute right to term inate on written notice the membership of any member if monies due to the Owner falls in excess of 30 days in arrears. Joining fees and subscription fees are inclusive of value added tax (if any).
CANCELLATION AND SUSPENSION
8. The Owner reserves the right to refuse admission or to renew a membership and/or cancel membership immediately on notice if any member shall have committed a breach of the Rules or if any member whose conduct is such that in the reasonable opinion of the Owner causes nuisance or annoyance to the other Club members or to other users of the Club facilities and is likely to endanger the good reputation of the Club. (A member whose admission is refused and/or whose membership is cancelled shall not be entitled to any refund of joining fee or annual subscription.)
9. Membership may be cancelled by the member at any time by no less than 30 days notice in writing to the Owner, in which case membership will lapse upon expiry of such notice.
10. When terminating a membership a member paying by direct debit should cancel this with their bank after their 30 days written notice period. The direct debit guarantee will apply as per normal.
11. Suspension of membership is at the sole discretion of management. However, a membership will not be suspended for a period of less than one month.
CHILDREN AND JUNIORS
12. Children of 16 years and below may not use the sauna/steam room, gym and spa bath. At no time may children use the facilities of the Club unaccompanied.
FACILITIES
13. A member is entitled to use the facilities of the Club available under the relevant category of membership. The Owner may at any time withdraw all or any part of such facilities for any period or periods or on a permanent basis in connection with any repair, alteration or maintenance work or for any event.
14. Use of the fitness suite and exercise studio is restricted to members over the age of 16 who have undertaken instruction in the safe use of the equipment. Temporary members, Hotel residents and guests may use the fitness suite and exercise studio at the discretion of the Owner, provided a disclaimer form is completed prior to use.
15. The use of the solarium is at the member’s own risk, and it is advised that medical advice is sought before using the facility. A disclaimer form must be completed before first use of the solarium.
16. Members and their guests use the swimming pool area at their own risk. No running, jumping, diving in the pool is allowed. Children under 16 must be accompanied in the pool and the pool area by an adult. For health and hygiene reasons, it is necessary for all members and their guests to shower before entering the pool. Showers are provided for this purpose in the changing area. Radios, lilos and anything which the Owner in its absolute discretion considers to be detrimental to use of the pool, are not permitted.
17. Members and their guests are particularly advised not to undertake strenuous physical activities for which they might be medically unfit, and the Owner will not be in any way responsible for any harm which may come to a member or guest as a result of their undertaking within the Club any activity which is beyond their physical capability. Members and guests who have any reservations as to their physical condition are advised to have a medical check-up before embarking on any exercise.
GUESTS
18. Only adult members may introduce guests. All guests must be accompanied by a member, be signed in at the Club reception and pay the appropriate guest fee. Members must ensure that their guests abide by the Rules and accept responsibility for their guest’s behaviour. A maximum of two guests may accompany a member, unless authorised prior to the visit with the Club manager.
MISCELLANEOUS
19. Members, guests and visitors are asked to wear a form of dress appropriate to the activity on all occasions.
20. No crockery, glasses or food are allowed in the changing rooms, fitness or swimming areas or designated areas in the interests of safety and hygiene.
21. No pets will be allowed in the Club buildings or grounds, with the exception of guide dogs.
22. Entry to the Club is only permitted at the Club reception entrance. Fire exits, which are clearly marked, are there in the interests of public safety and, in the event of a fire, members and guests are asked to make their way in an orderly fashion to the nearest available exit.
23. All lost property found on the premises should be handed in to the Club reception. Lost property will be disposed of after three months.
24. Hours for opening are as follows: Monday – Friday 6.00 am – 10.00 pm Saturday – Sunday 8.00 am – 08.00 pm Bank Holidays Restricted Opening Hours (see Bulletin Board).
25. Members and guests should vacate all facilities 15 minutes before the Club’s closing time.
26. Use of any photographic equipment in the Club can only be allowed with strict permission of the Leisure Club Manager or staff. Use of photographic equipment in the changing rooms is completely prohibited and can result in termination of membership or prosecution.
LIABILITY
27. The Owner’s liability for damage or loss to members’ or guests’ property is strictly limited to any damage or loss suffered as a result of negligence of the Owner, its staff or its agents. With this exception, the Owner will not accept liability for safety of members’ or guests’ personal property brought on to the Club site. Property stored in lockers provided at the Club is stored at the member’s risk, and no liability will be accepted by the Owner. Lockers are provided on a daily basis only.
28. Car parking is free in Broad Street Mall car park, but is subject to availability. The Club may remove this privilege as and when it deems necessary. Cars parked in this car park or within the grounds of the Hotel, and all contents in them, are left at the member’s risk and the Owner will accept no liability whatsoever in respect of them.
29. The Owner cannot accept any liability for any accident to any member or guest that may occur on the premises or within the grounds of the Hotel, other than liability which may arise from the negligence of the Owner, its staff or its agents. Any member or guest who suffers an accident on the Club premises or in the Hotel grounds must report the accident, and the circumstances under which it occurred, to the duty manager immediately following the accident.
RULES AND AMENDMENTS
30. By their membership, members accept and agree to be bound by the Rules.
31. The Club is a proprietary club owned by HPI who will control the management of the Club and the facilities. Members will be required to comply with any reasonable directions which the Owner may give to ensure the smooth operation of the Club, the use of the facilities, and the convenience of all members.
32. Any dispute or difference which may arise in regard to the interpretation of the Rules and the Constitution and/or rules of any committee of members, shall be determined by the Owner, whose decision shall be final and binding.
33. The Owner reserves the right to amend the Rules at any time. Notification of any such change will be posted on the Club notice board.
